Gunmen kidnap Italian embassy security agent in Yemen

Unknown gunmen kidnapped on Sunday an Italian embassy security agent in Sanaa, a Western diplomat and a Yemeni security official said.

The man was taken hostage from a street close to the mission in Hadda neighbourhood in southwestern Sanaa, the diplomat said, requesting anonymity.

A security official in Sanaa confirmed to AFP that an Italian man was kidnapped and taken to an unknown destination. Police were working to identify and track the kidnappers, he said.

In Rome, a foreign ministry spokesman confirmed the kidnapping.

"We confirm that an Italian citizen working as a security agent at the embassy has been kidnapped," a ministry press officer said.

"The foreign ministry's crisis unit has been activated and is co-ordinating efforts for his release. We cannot supply any more information at this time, for risk of compromising rescue efforts," he said.

Italian news agency ANSA later cited officials as saying the man is a member of Italy's Carabinieri military police force. It also said he was picked up while in civilian clothes in a shop near the embassy.

Contacted by AFP, the ministry declined to comment on the report.

Foreigners are frequently kidnapped in Yemen by armed tribesmen, who use them as bargaining chips with the authorities.

More than 200 people have been abducted in Yemen over the past 15 years. The majority have been freed alive and well.

A French staffer with the International Committee of the Red Cross who was kidnapped in April in the northern port city of Hudaida was released earlier this month unharmed.

But a Swiss woman kidnapped by Al-Qaeda militants in March, also from Hudaida, remains a hostage.

Tajik forces demand rebels hand over former warlord

DUSHANBE (Reuters) - Tajik government forces demanded rebel commanders lay down their arms and hand over a former warlord on Thursday, a security source said, as the two sides began a second day of talks after a battle which killed 42 people.

President Imomali Rakhmon called off a military offensive after the fierce fighting on Tuesday in a remote mountain region next to Afghanistan. Government troops continued to patrol the area on Thursday.

The ceasefire in the autonomous Gorno-Badakhshan region followed a campaign to capture former warlord Tolib Ayombekov, a show of strength by a government whose control over parts of the Central Asian state remains fragile 15 years after a civil war.

Twelve soldiers and 30 rebels were killed in the operation to apprehend Ayombekov, who fought against Rakhmon's troops in a 1992-97 civil war before receiving a government job in the peace deal that ended the conflict.

The government has offered amnesty to all rebels except the four fighters, including Ayombekov, it accuses of killing the regional head of the State Committee on National Security, whose murder on Saturday was the trigger for the military offensive.

"We are trying to persuade the fighters to lay down their arms and hand over the four suspects, including Ayombekov," a senior Tajik security source said on condition of anonymity.

"It could take a week or two. That's still better than shooting each other," he said. "Of course, they cannot continue forever. We've suffered heavy losses, but we will suffer more to end this situation if they do not agree to our conditions."

Tajikistan is the poorest of 15 former Soviet republics. Tens of thousands died in its civil war, in which Rakhmon's Moscow-backed troops fought a loosely aligned opposition that included many Islamist fighters.

Former imperial master Russia still has 6,000 troops stationed in Tajikistan, its largest military deployment abroad and a bulwark against the threat of Islamist violence spilling across the Afghan border when NATO pulls its troops out in 2014.

Khorog, capital of the Gorno-Badakhshan region and the town nearest to the fighting deep in the Pamir mountains, was calm on Thursday, the security source and a local resident said. Most communications were cut off for a third consecutive day.

The United States embassy in Dushanbe said in a statement it was worried about the safety of civilians in the area and urged authorities to hold investigations into "incidents" in Khorog.

Gorno-Badakhshan, separated from Afghanistan by the Pyandzh river, is an autonomous region where the authority of the central government is fragile. Most of the 250,000 population sided with the opposition during the civil war.

Ayombekov has denied involvement in the death of Maj.-Gen. Abdullo Nazarov, head of the regional branch of the GKNB, successor to the Soviet-era KGB. The GKNB has said his gang has been involved in smuggling drugs, tobacco and precious stones.

This was a trademark case involving, as the case name suggests, a dispute over various REARDEN-formative marks, which apparently were inspired by the "Hank Rearden" character in Ayn Rand's Atlas Shrugged.

The first issue of interest was the Ninth Circuit's discussion of the "use in commerce" requirement for service marks, not because the opinion broke new ground but because it is an issue I still often hear discussed even among trademark attorneys.

The court emphasized that there are two elements required for a service mark to be used in commerce--the mark must be "used or displayed in the sale or advertising of services" and "the services are rendered in commerce"--both of which must be satisfied.? Evidence of actual sales, or the lack of such evidence, is not necessarily dispositive of the "use in commerce" determination, the court noted.? Rather, non-sales activities, like solicitation of potential customers, are relevant to the "totality of the circumstances" analysis used in the Ninth Circuit to determine whether both prongs of the "use in commerce" requirement have been met.

The second legal issue involved the "evidence of actual confusion" factor of the Sleekcraft "likelihood of confusion" factors used in the Ninth Circuit in trademark cases.? Specifically, the Ninth Circuit concluded that "non-consumer confusion" may be relevant to the "likelihood of confusion" inquiry "in three specific and overlapping circumstances" including:

where there is confusion on the part of:? (1) potential consumers; (2) non-consumers whose confusion could create an inference that consumers are likely to be confused; and (3) non-consumers whose confusion could influence consumers.? In all three instances, the non-consumer confusion bears a relationship to the existence of confusion on the part of consumers themselves.

The court found support for its conclusion that "non-consumer" confusion may be relevant in:? (1) the well-established relevance of confusion on the part of potential consumers; (2) the prior use of "non-consumer" confusion as a proxy for consumer confusion (citing TrafficSchool.com, Inc. v. Edriver Inc., 653 F.3d 820 (9th Cir. 2011)); and (3) prior decisions recognizing that "non-consumer" confusion can contribute to consumer confusion as in the case of "post-purchase confusion" (citing Karl Storz Endoscopy-Am., Inc. v. Surgical Tech., Inc., 285 F.3d 848 (9th Cir. 2002)).

Summing it up, the court stated that:

it appears to be a matter of basic common sense to recognize the very real possibility that confusion on the part of at least certain non-consumers could either:? (1) turn into actual consumer confusion (i.e., potential consumers); (2) serve as an adequate proxy or substitute for evidence of actual consumer confusion (i.e., non-consumers whose confusion could create an inference of consumer confusion); or (3) otherwise contribute to confusion on the part of the consumers themselves (i.e., non-consumers whose confusion could influence consumer perceptions and decision-making).

The case cite is Rearden LLC v. Rearden Commerce, Inc., No. 10-16665 (9th Cir. June 27, 2012).

New recruits in the fight against disease: Anti-bacterial 'killing machine' deciphered

ScienceDaily (July 23, 2012) ? Scientists have discovered the structure and operating procedures of a powerful anti-bacterial killing machine that could become an alternative to antibiotics.

In research published in the Proceedings of the National Academy of Sciences, scientists from Monash University, The Rockefeller University and the University of Maryland detail how the bacteriophage lysin, PlyC, kills bacteria that cause infections from sore throats to pneumonia and streptococcal toxic shock syndrome.

Bacteriophages, viruses that specifically infect and kill bacteria using special proteins called lysins, have been investigated as possible treatments since 1919. However, with the discovery of antibiotics in the 1940s, 'phage therapy' was generally abandoned.

In collaboration with Professor Vince Fischetti at Rockefeller and Dr Dan Nelson at Maryland, Monash researchers Professor James Whisstock, Associate Professor Ashley Buckle and Dr Sheena McGowan from the School of Biomedical Sciences, have spent the last six years deciphering the atomic structure of PlyC, to better understand its remarkable anti-bacterial properties.

Dr McGowan said PlyC looked a little like a spaceship.

"PlyC is actually made from nine separate protein 'parts' that assemble to form a very effective bacterial killing machine. It actually resembles a flying saucer carrying two warheads," Dr McGowan said.

"It operates by locking onto the bacterial surface using eight separate docking sites located on one face of the saucer. The two warheads can then chew through the surface of the cell, rapidly killing the bacteria."

Associate Professor Buckle said the PlyC, which attacks the streptococci bacteria, was a very promising target for the future development of new drugs.

"PlyC, in its purified form, has been shown to be 100 times more efficient at killing certain bacteria than any other lysin to date -- even faster than household bleach," Associate Professor Buckle said.

First identified in 1925, PlyC was purified in the 1960s by Professor Fischetti, but its atomic structure proved elusive until now.

"Scientists have been trying to decipher the structure of PlyC for more than 40 years. Finally knowing what it looks like, and how it attacks bacteria, is a huge step forward," Dr McGowan said.

All the signs were there.

A couple of hours later, Woods tapped in for par at No. 18.

The charge had fizzled. There was still a lot of work to do.

The good news for Woods is he didn't collapse Saturday, even after a poor start, as opposed to his dismal weekend performance at the U.S. Open last month. But he's never won any of his 14 major championships by rallying in the final round, and he'll have to make up a daunting five-shot deficit if he's going to snatch the claret jug from Adam Scott.

Woods shot a par-70 that kept him in the game.

Just barely.

"Well, I turned it around," Woods said, looking for the bright side. "I got off to an awful start and battled back and got myself right back in the mix again going into tomorrow. I'm right there."

Well, not quite.

Woods began the day four strokes behind Brandt Snedeker, the 36-hole leader. Now, the deficit between Woods and the new leader is even larger. Plus, there's two players between Woods and the top spot. Snedeker, who had a miserable day but rallied at the end, and Graeme McDowell, who was solid all the way, are four strokes behind Scott's 11-under 199 total. Next is Woods at 204.

On moving day, he moved the wrong way, raising the very real possibility that the longest major drought of his career ? a little over four years since he hobbled to victory at the 2008 U.S. Open ? will carry on at this Open.

Of course, it could've been worse. Woods started the day by running his tee shot over the green at the par-3 first hole. A tentative chip came up 8 feet short, and he missed the putt. After another bogey at the third, it appeared he was headed for a repeat of the last major championship.

Woods was actually tied for the 36-hole lead at the U.S. Open, but a 75 on Saturday wiped out his chances.

This time, at least, he rallied.

That birdie putt at No. 6, rapped from one side of the green to the other, turned the tide. Woods rolled in a much shorter birdie at the next hole, came up about an inch short of a third straight birdie from the fringe at No. 8, then stuck his tee shot at the par-3 ninth to 4 feet, setting up yet another birdie.

"Considering that I got off to such a bad start, I figured if I could get to 1-over par or even for the day through the turn, that would have been a positive going to the back nine," Woods said. "I actually happened to turn at 1 under for the day, which was a bonus."

Woods had a prime opportunity to take off another stroke at the par-5 11th, but he misread the putt and settled for par. Another misjudgment at the 15th led to bogey, pretty much snuffing out any chance of getting on a roll coming to the clubhouse.

"I had a few looks on that back nine," Woods said. "I just didn't make them."

For a while, he was at least positioned to play in the final group with Scott, which would have allowed him to put some firsthand pressure on a guy who's never won a major ? and set up all sorts of intrigue.

Scott's caddie is Steve Williams, who used to be on Woods' bag. They were more than just employer and employee, they were good friends. But the collapse of Woods' personal life put a severe strain on their relationship. Woods decided to change caddies as he struggled to rebuild his game and his reputation.

Not surprisingly, Williams was none too pleased about being let go. He quickly caught on with Scott, then went off on Woods after his new employer won at Firestone last year. Just imagine the possibilities if Woods and Scott had played together in the last group of a major, with Williams right in the midst of things.

Instead, Woods will again play in the next-to-last group, as he did Saturday, paired with Snedeker. McDowell and Scott will bring up the rear.

"Final pairing, whatever it may be, I was just trying to cut into that lead," Woods insisted. "I'm five back, so Adam is in a great spot right now."

The forecast Sunday calls for the wind to finally pick up after three days of sterling weather, which might be the best chance for everyone else to run down a leader with a comfortable edge. Then again, Woods has never thrived in inclement weather. In perhaps the worst Open conditions he's faced, a driving wind and rain at Muirfield in 2002, he struggled to an 81 ? his highest score as a professional.

"I've just got to execute my game plan," Woods said. "I know the forecast is one thing, but let's see what actually happens. Whether the wind blows or not, I've still got to go out there and post the round I know I need to post and execute my plan."

Sylvia Puente: How to Court the Latino Voter: Offer Real Solutions on Education

The fervor of the partisan politics and cross-aisle finger-pointing in Washington DC seems to be increasing in direct proportion to the waning number of days before the November 6 election. But in today's hyper-partisan climate of deep divides between the red and the blue, both parties seem to find common ground on one issue: Our schools are failing too many of our students.

Case in point: Both Condoleezza Rice and Joe Biden have spoken to the importance of education in recent public addresses. In late May, the former Secretary of State visited my hometown to address the Executives' Club of Chicago, cautioning that "the urgent need to reform our country's K-12 education system poses one of our greatest security threats." And just last week, the Vice President echoed her message at the National Council of La Raza conference in Las Vegas: "Quality early education is the single most consequential bit of education for all Americans, but particularly Hispanic children."

While both parties agree on the urgency of quality education for all students--and give plenty of lip service to the need for reform--neither has provided a sound education investment that produces solid academic outcomes for our most vulnerable groups of learners. As of late, federal school financing has been either punitive (No Child Left Behind) or competitive (Race to the Top) but not sustainable. And at the local level, antiquated school funding formulas still rely too heavily on local property taxes, with state-level budget cuts only intensifying inequalities. Cash-strapped Illinois has recently applied a backwards proration to its school financing that actually deepens the equity gap between the have and have-not districts. Now more than ever, a student's ZIP code too often determines the quality of his or her education.

The result of this funding quagmire is an almost perfect, three-way correlation between poverty, majority-minority public schools, and low academic performance. In a city like Chicago, these three phenomena conspire to put 90 percent of Latino students in a school with an academic watch or warning status. It follows, then, that Latino students across our state are almost as likely to drop out of school as they are to graduate.

Exacerbating these low-income, high-minority districts' fiscal woes is the fact that well-intentioned educational reforms are often so focused on elevating standards that they neglect to build in the fiscal and professional development supports necessary to help students meet them. Illinois, for example, has plenty of progressive preschool policies in place--the state is the first in the nation to require that bilingual preschool be offered for students who speak a language other than English at home -- but lacks the funds to properly implement them. After years of fiscal crisis, Illinois' coffers are empty, leaving educators scrambling to earn the extra credentials and purchase additional materials required to comply with the unfunded mandate, set to be fully implemented in 2014.

In that same vein, our K-12 system will soon receive an overhaul with the impending state-by-state implementation of the Common Core Standards, built on the promise of leveling the academic playing field by demanding the same high-level skills -- including internationally benchmarked critical thinking and language reasoning competencies -- from all students. But as shrinking state and local budgets offer minimal resources to train teachers or update curricula in light of the new standards, advocates cast a wary eye at the cyclically low-performing, cash-strapped schools that serve Latinos and wonder if these students will simply fall further behind.

Education is the great equalizer, so the saying goes -- but only if all things are equal. Quality schools can't be built on the backs of collapsing local economies.

The Latino Policy Forum recently released a report that optimistically outlines a way forward for educational reform, for building a system that provides a culturally relevant, quality education for Latinos and for all students. But the bottom line is that true reform will require resources, not rhetoric from Washington, D.C. and the state: An effective, lasting overhaul of our schools requires our government taking a long, hard and likely uncomfortable look at the way it finances them.

Savvy voters of all political persuasions can connect the dots between education reform and another white-hot bipartisan issue: our economic future. The United States' growing cohort of Latino students is poised to be either an economic engine or an economic challenge, depending on our ability to reform schools to properly prepare them. As Latino voters consistently indicate that both education and the economy will determine how they cast their vote this November, candidates should take note. They have an opportunity to pitch a plan for federal financing that truly fixes failing local schools -- and a responsibility to turn the rhetoric around reform into reality once in office.
